Court Denies Elon Musk’s Attempt to Block OpenAI’s Transition to For-Profit Model
OpenIA intends to keep the non-profit arm live with activating its for-profit arm to balance endeavours of funding and greater good.

The federal court has denied Elon Musk’s request for a preliminary injunction against the company’s transition to a for-profit organization from a non-profit one. The court remarked that he had not “demonstrated likelihood of success on the merits” of his claims. The court went further, dismissing several of his claims from the case entirely. 

On the other hand, OpenAI claims that its non-profit wing is not going anywhere. Rather, the company is trying to balance both wings to continue contributing to its goals of the larger human good and also attract good investments for its endeavors. OpenAI claims as:

  1. They intend to keep the non-profit as a crucial part of our work to achieve our mission. 
  2. They want to ensure that the company is supported by a successful business and is in a stronger position than ever. 

The company's board intends to strengthen the non-profit so that it can deliver on its mission for the long term. The company doesn't intend to sell it. They are doubling down on their work. It will have a significant stake in our proposed public-benefit corporation, making it one of the most well-resourced non-profits in history.

In an earlier blog, OpenAI had called out Elon Musk as he continues to pursue a petition against OpenAI going for-profit, contradictory to his own opinion to make OpenAI so long back in 2017 when he was a board member of OpenAI and also aspiring to acquire a majority stake.

Back in September 2024, OpenAI had opted to become a for-profit body, keeping its not-for-profit arms to exist even then. Owing to a fund crunch and aggravating losses, OpenAI is eagerly exploring ventures for fundraising to fund its growth and the bigger AI mission it’s working on.
